General Terms and Conditions

These General Terms and Conditions (the “Terms and Conditions”) are issued under Section 1751 et seq. of Act No. 89/2012 Coll., the Civil Code. They govern the mutual rights and obligations of the Seller and the Buyer (consumer or business customer) arising in connection with or pursuant to a purchase contract concluded through the online store located at www.denariuswine.com (the “E‑shop”). The Terms and the purchase contract are concluded in the Czech language.

I. Basic Provisions

These Terms and Conditions set out the rules for purchasing goods via the E‑shop, including information on goods, prices, ordering, payment and delivery terms, withdrawal from the contract, rights arising from defective performance, personal data protection, and out‑of‑court dispute resolution.

II. Information about Goods and Prices

• Information about goods, including prices, is provided for each item in the E‑shop.
• All prices are stated inclusive of VAT and all related charges.
• The Seller reserves the right to change prices. The price valid at the time of ordering is always displayed during checkout.

III. Order and Conclusion of the Contract

• The Buyer may place an order either via a customer account or without registration.
• The purchase contract is concluded when the Seller confirms the order to the Buyer’s e‑mail address.
• The Seller may refuse an order, in particular if the goods are unavailable or if there is an obvious error in the price.

IV. Payment Terms

The purchase price may be paid by bank transfer, by online payment card (payment gateway), or cash on delivery (COD). Title to the goods passes to the Buyer only upon full payment of the purchase price.

V. Delivery of Goods

• Goods are delivered via contractual carriers (e.g., TOPTRANS, FOFR, Zásilkovna).
• Shipping costs are shown during checkout. For orders above a specified amount (e.g., CZK 1,300), shipping may be free of charge.
• Upon receipt, the Buyer must check that the packaging is intact; any damage should be reported to the carrier and the Seller without delay.

VI. Withdrawal from the Contract (Consumer)

• A consumer has the right to withdraw from the contract without giving any reason within 14 days of taking delivery of the goods.
• To withdraw, the consumer may use the model withdrawal form (see Annex – Model Withdrawal Form).
• The Buyer bears the direct costs of returning the goods.
• Refunds will be made using the same payment method used for the original transaction, no later than 14 days after withdrawal. The Seller may withhold the refund until receipt of the returned goods or proof that the goods have been sent back.
• Returned goods must be complete, undamaged, and in their original packaging.
• Withdrawal is not possible for goods liable to deteriorate or expire rapidly or where the goods have been opened (e.g., foodstuffs, alcoholic beverages).

VII. Rights from Defective Performance and Complaints

• Unless stated otherwise, consumers are entitled to a 24‑month warranty period.
• Claims may be submitted in writing to info@denariuswine.com.
• Complaints will be handled without undue delay, no later than within 30 days.

VIII. Personal Data Protection (GDPR)

Personal data are processed for the purpose of order processing, delivery of goods, and accounting. The legal bases are the performance of a contract, compliance with legal obligations, and the controller’s legitimate interests (including marketing). Personal data are retained for the duration of the contract and thereafter for the statutory periods (e.g., accounting records for 10 years).

The Buyer has the right to access, rectification, erasure, restriction of processing, portability, and to object, as well as the right to lodge a complaint with the Office for Personal Data Protection (ÚOOÚ). The Buyer may opt out of commercial communications at any time.

IX. Out‑of‑Court Dispute Resolution

The consumer may submit a dispute for out‑of‑court resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) or use the EU ODR platform at ec.europa.eu/consumers/odr.

X. Final Provisions

• These Terms and Conditions are governed by the laws of the Czech Republic.
• All arrangements between the Seller and the Buyer are archived electronically.
• The current version of the Terms and Conditions is published on the Seller’s website.
